Terms of Service

Accepting these terms

These terms govern your use of Smolish. By creating an account or using the service, you agree to them and to the Privacy Policy. If you use Smolish for an organisation, you confirm you can accept these terms for it. Do not use the service where doing so would violate applicable law.

Your account

Give accurate information, keep your sign-in method secure, and do not share or sell access to your account. You are responsible for activity on your account. You can delete it yourself from Account settings. Account deletion is permanent except for limited data we must retain under our Privacy Policy.

Rules for content and conduct

Do not post, upload, message, or otherwise distribute illegal content; sexual exploitation or any sexual content involving minors; threats, harassment, hate, doxxing, impersonation, scams, spam, malware, copyright infringement, or instructions to commit wrongdoing. Do not post gore, graphic violence, animal cruelty, or other shock content. Do not evade safety controls, scrape the service, manipulate engagement, interfere with the service, or use automated access without our written permission.

We use reports, automated signals, and human review to enforce these rules. We may remove content, limit reach, suspend features, or suspend or ban accounts when we reasonably believe a violation, safety risk, or legal requirement exists. Serious or repeated violations, including gore and other prohibited content, can result in an immediate permanent ban.

Appeals

If your content is removed or your account is suspended or banned, you may appeal by opening a private ticket at discord.gg/facedev. Include your Smolish handle, the action you are appealing, and why you think it was incorrect. We will review appeals reasonably, but safety and legal actions may remain in place while we review them.

Your content

You retain ownership of content you submit. You grant Smolish a worldwide, non-exclusive, royalty-free licence to host, copy, process, adapt for technical delivery, display, distribute, and make your content available as needed to operate, improve, secure, moderate, and promote the service. This licence ends when your content is deleted, except where copies must remain for legal, safety, backup, or technical reasons, or other users have reused it as the service permits. You confirm you have the rights needed to grant this licence.

Our service

We may change, pause, or discontinue features, including recommendations and integrations. We do not guarantee that content is accurate, available, safe, or suitable, and user content does not represent our views. To the fullest extent permitted by law, Smolish is provided “as is” and “as available,” without warranties of any kind.

Liability and law

Nothing in these terms excludes rights or liability that cannot be excluded under applicable law. Otherwise, to the fullest extent permitted by law, Smolish and FaceDev are not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages arising from use of the service. These terms do not limit consumer protections that apply in your place of residence.

Changes and contact

We may update these terms by posting a revised version and changing the effective date. If a change is material, we may provide additional notice in the service. For support, safety, or legal questions, contact [email protected]. Discord is only for moderation appeals.
